Terms of service

These terms are an agreement between you and TAM Ventures LLC (“Valenso”, “we”, “us”) for your use of the Valenso website and app (the “service”). By creating an account you accept these terms and our Privacy Policy. If you don't agree, please don't use the service.

Valenso is a record-keeping tool. It is not a broker, investment adviser or tax adviser, and nothing in the service is investment, financial, legal or tax advice or a recommendation to buy or sell anything.

Trading and investing involve risk, including the loss of more than you invest. You alone are responsible for your trading decisions and their results.

Statistics and profit and loss figures are calculated only from what you enter. They may differ from your broker's records because of missing or mistyped fills, fees, corporate actions, currency conversion or other factors. Always rely on your broker's official statements, and on a qualified professional, for tax reporting and important decisions.

• You must be at least 18 years old and able to form a binding contract.
• Give a real email address you control, and keep your password private. You are responsible for activity on your account.
• One account per person. Accounts may not be shared or resold.
• Tell us promptly at support@usevalenso.com if you think someone else has accessed your account.

The service is currently in early access and is free. Early access is limited to the first 200 accounts. During early access, features may change, be added or be removed, and the service may sometimes be unavailable while we improve it.

We plan to introduce paid plans, currently expected to be $5 per month or $55 per year. We will email you at least 30 days before early access ends. You will never be charged unless you choose a paid plan and give payment details, and if you don't, you can still download your data before access ends.

You own everything you put in your journal. You give us a limited permission to store, copy and process it only as needed to run the service for you, keep it secure and back it up. This permission ends when you delete the content or your account, except for copies in backups, which expire on their normal schedule.

You are responsible for what you enter, and you must have the right to enter it.

Please don't:

• break the law, or use the service to help anyone else break it;
• try to access other users' data, probe or attack our systems, or get around security or usage limits;
• scrape, overload or disrupt the service, or use automated means to create accounts;
• copy, resell or build a competing product from the service;
• upload malware or content you have no right to share.

If you find a security problem, please tell us at support@usevalenso.com instead of exploiting it.

The service, including its software, design and the Valenso name and logo, belongs to us and is protected by law. These terms give you a personal, non-transferable right to use it; they don't transfer any ownership. If you send us feedback, we may use it without owing you anything.

You can delete your account at any time in Settings, which permanently deletes your data. We may suspend or close accounts that break these terms or put the service or other users at risk; where reasonable, we will tell you first and give you a chance to download your data. If we ever shut the service down, we will give you at least 30 days' notice so you can export your journal.

To the extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, including that it will be uninterrupted, error-free, or that calculations will be accurate for your purposes. Keep your own records of anything important.

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for trading or investment losses, lost profits or lost data, arising from your use of the service, even if we were told they were possible.

Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50. Some places don't allow these limits, so they may not all apply to you; nothing here limits rights you have that can't be limited by law.

These terms are governed by the laws of the State of Nevada and applicable United States law, without regard to conflict-of-law rules. Before filing any claim, please contact us so we can try to resolve it informally. If you live in the UK or EU, you also keep the protection of your local consumer laws and may bring claims in your local courts.

We may update these terms as the service changes. For material changes, we will email you at least 30 days before they take effect. If you keep using the service after that, the new terms apply; if you don't agree, you can delete your account.
